TNM Smart data products have different terms and conditions of use that describe the different business rules defined for the different TNM Smart data products. Other conditions are in general in nature and apply to all TNM Smart data bundles while others are specific and only apply to particular products. Below are the Terms and Conditions for the current TNM Smart data products;

  • General Rules for TNM Smart Data

    Below are the general rules for TNM Smart data;

    • Every TNM data product will have a defined Fair Usage Policy (FUP) either on the network level or customer level. When the FUP is defined on customer level TNM will communicate to its customers while if the FUP is defined on the Network level TNM shall only communicate to MACRA and shall not communicate to the public as this information would be part of its company secrets.
    • At any time during a billing cycle, once the aggregate data usage of a customer in the relevant billing cycle reaches the relevant Fair Usage data threshold applicable to the customer, TNM shall have the right to reduce or restrict and terminate the data access as per the product definition.
    • Billing cycle refers to the period beginning with the date of an invoice and ending on date immediately preceding the date of the next invoice and it varies from customers to customers for postpaid data customers or the date and time a customer has subscribed to a prepaid smart data bundle. "Fair Usage Data Threshold" will vary from customers to customers depending on the relevant service plans subscribed by the customer.
    • Depending on the services subscribed, additional data usage charges may apply according to the thereafter usage charges or data charge cap (if applicable) once a customer's data usage exceeds the usage entitlement under the relevant service plan. In any circumstances, TNM will not terminate or suspend the data service if the data usage of the customer concerned has exceeded the relevant Fair Usage Data Threshold for prepaid customers while for postpaid customers we will terminate access.
    • TNM will send usage alerts to a customer within a reasonable time after our system has recorded that the aggregate data usage of a customer in the relevant billing cycle has reached the defined notification thresholds for the product.
    • Customers will not be able to carry over any bundle volumes into the next billing cycle after expiry of the validity period
    • TNM reserves the right to changes the terms of the FUP from time to time and shall communicate to all the respective stakeholders accordingly.
    • TNM will take all the precautionary measures to curb any sign of abuse in the event of unreasonable use of TNM smart data. The instances set forth below are some of the events that will be deemed “unreasonable” in the use of TNM Smart data. However, TNM has the right to determine from time to time what constitutes “unreasonable”:
    • Where customer’s use of TNM Smart Data products is reasonably considered by TNM to be fraudulent or to adversely affect the TNM Core Network or other TNM customers' use of or access to a TNM Service or the TNM Network.
    • Where Customer participation in a Promotion is reasonably considered by TNM to be fraudulent or to adversely affect the TNM network or another TNM customer's use of or access to a TNM service or the TNM network.
    • Access to TNM network through illegitimate means.
    • Using any program or the transmission of any communication or data to interfere with the normal operations of any TNM’s services.
    • Using any tool to compromise or breach any security features or other safeguards implemented by TNM in respect of any Services, network facility and/or content.
    • TNM intends to preserve the integrity of the network in order to provide all its subscribers with high quality mobile data services. Therefore TNM reserves the right to suspend or terminate service to customers whose improper or abusive use of mobile browsing may jeopardize TNM ability to deliver the best customer experience to other subscribers. TNM also reserves the right to modify the Fair Usage Policy from time to time to maintain the integrity of its network services.
    • In the event of Network problems where there is limited bandwidth available on the network or there are high levels of congestions on the network, TNM reserves the right to implement Fair Usage Policy on the network to ensure the optimal use of resources and customer experience. In the same manner TNM reserves the right to limit usage of its data bandwidth by customer or group of customers or change access priority or altogether limit access of some its data products or promotions.
    • Where a customer is in breach of this Fair Usage Policy (FUP), TNM may contact the customer to discuss changing their usage behavior so that it conforms to this Fair Usage Policy.
    • If, after TNM has contacted the customer and their unreasonable use continues, TNM shall, without further notice to the customer take the following actions:
    • Suspend or limit the Service (or any feature of it) for any period TNM think is reasonably necessary; and/or
    • Terminate their agreement in accordance with the relevant Terms & Conditions as defined in the Standard Form of service level Agreement.
    • TNM cannot guarantee the actual data access speed (upload and download) experience by the customers which is subject to the influence of various factors which are outside our control including but not limited to the features or functionality of the mobile devices, websites servers speed, lack of capacity, faults in other communications networks, the weather or radio interference caused by hills, tunnels or other physical obstructions.
    • The actual Terms and conditions for TNM Smart Data promotions and products at any given time will be defined and approved by management in a separate document.
    • When a customer successfully subscribes to all the Smart Social or Smart Surf data bundles and when browsing; the deduction and charging will first be prioritized to the subscribed Smart social bundle and after it is exhausted the deduction goes to the Smart Surf or Smart standard bundle and finally to the main account.
    • At all times TNM will make available its Terms and Conditions to its customers on its website and will also notify MACRA in writing of any changes to the policy.

  • Fair Usage Policy (FUP)

    A small number of users are responsible for generating large volumes of traffic on our network, which can impact the service we offer to our other customers. Our fair usage policy is designed to ensure that all of our customers receive a fast and reliable service. This document seeks management approval to upload the Smart Data Usage Policy of Smart data products on TNM website as follows;

    • Unlimited Smart Whatsapp Promotion

      Currently TNM is running an unlimited promotion on Whatsapp and below is the defined FUP;

      Price Plan Fair Usage Policy
      Unlimited Daily WhatsApp Bundle 500MB per day (24 hours)
      Unlimited Weekly Whatsapp Bundle 1GB per week (7 days)
      Unlimited Monthly Whatsapp Bundle 5GB per month (31 Days)

      The data volumes include both downloaded and uploaded data - a gigabyte is 1024 megabytes (MBs).

      The majority of our customers will not be impacted by the fair usage policy. However, if Customers use the following applications in general they are more likely to break the fair usage policy: peer-to-peer (P2P) file sharing software, streaming video services or software update services. Many of these applications continue to send and receive data constantly in the background. Even if they are not downloading a file, these applications may still be transferring data.

      Any content outside Whatsapp application like external links will be charged outside the Whatsapp bundle.

      If, in TNM’s reasonable opinion, the customer seems to be abusing the service in any way, such as violating the fair usage policy, TNM may ask the customer to moderate his/her behavior – and in extreme cases, we may limit the speed or block the customer’s access to data services or disconnect them from the network.

    • Free Facebook Promotion

      TNM is currently running a promotion for Free Facebook. Customers are able to update status, comment, like, upload and download pictures all for free. Nonetheless, it is TNM’s responsibility to ensure that its network is controlled and not abused and to ensure other services are not affected by the Facebook promotion. To this effect the following rules have been defined;

      • Sufficient capacity has been dedicated to Facebook during the promotion period. TNM will review this from time to time ensure optimal Utilization of network resources.
      • Instagram, VoIP and Video traffic is excluded from the free promotion hence customers will be charged accordingly for accessing those services.
      • All third party links outside Facebook also is excluded from the free promotion thus customers will be charged accordingly for accessing these links.
      • Promotion excludes customers using blackberry browser while all the other browsers including but not limited to the following are included: Opera Mini, Nokia, Android and the like.

    • Opera Mini Bundles

      Opera Mini bundle is a browser specific bundle and customers can only use the Opera Mini bundle when they use Opera Mini as a browser. Like all TNM smart data bundles Opera Mini bundles have volume and validity defined as part of the FUP , but in addition the following special rules apply:-

      • Only customers with Opera mini browser will be able to use the bundle.
      • Bundle only supports browsing traffic and any streaming and downloading traffic will be charged outside the bundle accordingly.

    • Smart Business Bundles;

      Smart Business Bundles are bundles for corporate postpaid and prepaid customers. Like all TNM smart data bundles smart business bundles have volume and validity defined as part of the FUP , but in addition the following special rule applies:-

      All these business bundles will be offered on pro-rated basis and customers will have an option to add as many bundles as possible at any point in time within the calendar month and bundle will allocate volume and validity corresponding to the time stamp within the calendar month.

    • Zero rated TNM website

      All TNM customers shall not be charged for accessing the following websites:

A: - The bundle only works for browsing using the opera mini browser. Any traffic outside the browser , like streaming and downloading which happens outside the browser is charged outside the bundle accordingly.

Q-What happens if one buys a bundle while with an active session and being charged from Smart Yaboo Rate?

A: - if one still has an active session he/she will continue to be charged on the smart yaboo rate until the session terminates then bundle charging priority will take effect. Therefore customers are encouraged to terminate all active sessions once they have bought a new bundle. The most sure way to terminate all active sessions is to switch off and switch on the device.

A: The speed for the smart data bundles will depend on the following factors; the technology being used either 2G or 3G, number of people within the data network coverage area , distance from the site and the weather conditions just to mention a few . Therefore, it is very hard to say exactly the speeds that the customer will experience but on average the average speed on TNM for 2G is 128kbps while on 3G is 512 kbps.

A: You will either be charged with the standard data charge of or it will be deducted from your data package. You will also be charged for the following:

  • Clicking on links outside of Internet.org.
  • Running background applications or automatic phone updates.
  • You may also be charged for viewing photos and videos on Facebook within Internet.org.

Q: Can I use other internet packages while using the Internet.org?

A: Yes, you can use any mobile internet package or call/text & data combo offers while using the Internet.org promo. Using the websites provides via Internet.org does not deduct from your balance.

Q- How do I use Internet.org?

A: For basic/feature phone:

  • Insert a SIM card from TNM.
  • Make sure mobile data is turned on in your phone's settings. Don't worry, Internet.org is free and won't deduct from your balance.
  • Click your internet browser icon (it might say Opera or Chrome, or look like a globe).
  • At the top in the address box, type in www.internet.org. It may take a few moments to load.
  • Accept the Terms of Service. Now you can use free websites on Internet.org!
  • For Facebook Users, if you already have the Facebook app, you can access Internet.org in the “more” menu in the upper right corner.

Q- How do I change the language of Internet.org?

A: For www.internet.org: If you’re in a country where Internet.org is available in more than one language, you can change the language by clicking “About Internet.org” at the bottom of the services list.

Q- I'm not able to load Internet.org (connection error or blank).

A: Let's make sure your settings are correct.

  • Turn off Wi-Fi in your phone's settings.
  • Turn on mobile data in your phone's settings. Internet.org will not deduct from your mobile data balance.

Q: What kinds of phones work with Internet.org?

A: Internet.org works on data-capable phones. On a feature phone (like the Nokia E series) if there is an Internet icon or logo in the phone menu, you are using a data-capable phone.

Q- Can I get Internet.org on my desktop computer?

A: No, the Internet.org app is only available on a mobile device.

Q: Can you access Internet.org using WiFi or other networks?

A: No. The free sites under Internet.org can only be accessed if you are using mobile/cellular data.

A: No. There is no iOS app.

Q- Why am I not seeing photos on Facebook when using Internet.org?

A: If you’re using Facebook through Internet.org, you may be seeing a free-data version of Facebook that has fewer photos. You can view the full Facebook experience by upgrading on your current version of Facebook, or by visiting www.facebook.com directly. Keep in mind that data charges will apply.

Q: Why are Facebook and TNM pinned to the top of the list of services?

A: Initially, users will see Facebook and TNM under the “Brought to you by” section at the top of the app list. After a few uses, the Internet.org app will transition to show the apps used “Most used.”

Q: Why isn't [specific website] included in Internet.org?

A: Facebook doesn’t currently have an agreement with them set up to provide the service as part of Internet.org. Please reach out to your operator to let them know you'd like to see them on Internet.org. Facebook recently introduced the Internet.org Platform, a way for developers to easily create services for Internet.org. People will soon be able to search through a variety of services and add the services to their homepage that they're most interested in using.
